Employers have a duty to help provide a healthy working environment for their nonexempt employees and provide them with legally mandated rest and meal breaks throughout their work day depending on the hours worked by the employee.

Many people are not aware that their rights are being violated every day! Employers must allow you an uninterrupted meal break of 30-minutes for nonexempt if they work a shift of more than 5 hours. An employee that works more than 10 hours is entitled to another 30-minute meal break.

Further, employees who work an 8-hour shift are also entitled to one 10-minute break every four hours. Every lunch break that is missed or interrupted entitles an employee to an extra hour of pay at their regular hourly rate and for missed breaks they can also receive another hour of compensation at their hourly rate.

Employers must not interrupt their employees for 30 minutes with any work-related duties during these rest meal breaks, and can have no control of the employee’s activity, meaning the employee can even leave the work site during their lunch break. 

If you have been missing your breaks because your employer doesn’t provide it or you are too overworked to even stop and take a break, then your employer may be violating California Law.

What if I'm not a U.S. Citizen or my status is undocumented?
